PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING BETHAWK.
1. Information about these terms, us, and how to contact us.
- These terms tell you information about us and the legal terms and conditions of the provision BetHawk or other services (“Service”), provided to you (“User”), through our website www.bethawk.co.uk (“our website”).
- The section headings in these Terms are provided for convenience only and do not affect the interpretation of any part of the agreement.
- We operate the website www.bethawk.co.uk, provide the Service, and can be contacted by email at any time at support@bethawk.com.
- By installing, subscribing to and/or using this Service, the User agrees to be bound by this agreement.
- We care about your privacy - our handling of your personal data is set out in our Privacy Policy.
2. Using this Service.
- We can in no way be held responsible for any losses arising from the use of this Service. The User must be aware that there are risks involved with every sports betting transaction, and we do not guarantee winnings from identified value bets and/or hedged value bets.
- We make no guarantee of the correctness of information presented and/or used as part of this Service, although we strive for our Service to use and present information which is accurate.
- While we aim for the Service to only simulate input where intended for proper operation, we can in no way be held responsible for any simulated input or the consequences of these inputs. Efforts have been taken to restrict simulated input to the target browser window and only the bookmakers’ websites. An example of a simulated input which could have an unintended consequence would be if an unrelated pop-up was displayed by the User’s device while an input is being processed.
- We can in no way be held responsible for bets placed or any other actions taken at any bookmakers’ websites. It is the responsibility of the User to comply with bookmakers’ terms and conditions, and the laws and regulations in their respective country regarding gambling and sports betting.
- You may only sign up for and/or use this Service if you are at least 18 years old.
3. Access to this Service.
- Access to the Service is provided by signing up on our website. By registering, you are granted a non-exclusive, non-transferable, revocable licence to access and use the Service in accordance with these Terms.
- A commission fee equal to 25% of the User’s net profit, calculated as the total profit across tracked bets during each 14-day commission period, is charged on a recurring basis, beginning from the date of the User’s first recorded bet.
- If a user hasn't had a recorded bet in over 14 days, their next 14-day commission period will start on the day of their next tracked bet.
- We reserve the right to change the commission rate at our sole discretion, with reasonable notice provided to Users.
- This fee is based on tracked betting activity and may be subject to discrepancies. Users may dispute any calculated commission prior to payment through our provided dispute resolution process.
- Disputes must be raised before payment is made. Once payment is completed, commission fees are deemed final and are not eligible for refund.
- Invoices are issued within 7 days of the end of a 14-day commission period, and are due within 7 days of issuance unless otherwise stated. If an invoice remains unpaid after the due date, we reserve the right to suspend or terminate your access to the Service until full payment is received.
- We offer a grace period of 48 hours following the invoice due date during which your access to the Service will remain active. If an invoice remains unpaid after this period, we may suspend or terminate access to the Service. We reserve the right to refer outstanding debts to a reputable debt collection agency. Any debt recovery costs charged by such an agency may be added to the outstanding balance only to the extent permitted by law and only where this has been included in these Terms.
- All prices and fees include VAT, where applicable, at the prevailing UK rate.
- You agree to provide your full name and postal address for billing purposes.
- Under our “No Win, No Fee Guarantee”, if a User’s net profit for a 14-day commission period is negative, no commission fee will be charged for that period. Losses will be carried forward, and commission will only be charged once the User’s cumulative net profit becomes positive and exceeds prior uncharged losses.
- We reserve the right to modify, enhance, or remove features or functionality of the Service at any time without liability.
- Access to bookmaker-specific functionality may be included as part of the Service. While we make reasonable efforts to maintain compatibility with supported bookmakers, continued access to specific bookmaker integrations is not guaranteed, and no refunds will be issued in the event such functionality is modified or removed.
- Bookmaker-related features may be temporarily unavailable due to maintenance, system updates, or other technical reasons. We will endeavour to provide advance notice where practicable.
- We reserve the right to suspend or terminate your access to the Service at any time, for any reason, at our sole discretion. This may include, but is not limited to, cases of non-payment, excessive or abusive use of the Service, use that interferes with the functionality or availability of the Service for others, suspected violation of these Terms, or any use deemed to be in bad faith.
4. Other important terms.
- If a court finds part of this contract illegal, the rest will continue in force. Each paragraph of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
- These terms are governed by English law and you can bring legal proceedings in respect of the Services in the English courts.
